Summary of Practice

John has a wealth of experience in prosecuting and defending all ranges of criminal cases throughout Scotland.  He has also appeared before the Privy Council.  He is regularly instructed by the Crown to prosecute cases at Solemn level. 

Additionally John is regularly instructed in personal injury cases and has represented both pursuers and defenders (insurers).  In addition to all types of drafting work, he has appeared in the Outer House and Inner House.  He has experience of high value cases and has been instructed in civil jury trials.

He has dealt with all aspects of personal injury law, including employer’s liability, road traffic law, industrial disease and product liability.

Cases, trials, inquiries

Crime: Hoekstra v HM Advocate  (No1)-(No5)  2000 SLT 602,  2000 JC 391, 2000 JC 559, 2001 JC 131, 2002 SLT 599.  Various authorities in procedure and human rights arising from an international drug smuggling case.

Reparation: Manson v Skinner 2000 SLT (Sh Ct) 161 and 2002 SLT 448.  Expenses- Tender, Award exceeding tender when added to the date of decree but not at date of tender.

Wells v Stenhouse, unreported June 2000, Procedure Roll Debate,  whether special reasons existed to preclude pursuers right to jury trial.
