Summary of Practice

Peter Barclay was admitted to the Faculty in 1995. He has extensive experience in property related litigation, particularly in the Scottish Land Court representing landlords and tenants in disputes under the Agricultural Holdings and Crofting Act legislation and also in litigation before the Lands Tribunal for Scotland. He successfully represented the Tenant in achieving a record reduction of rent for an agricultural holding in the major agricultural rent arbitration between Southesk Farms and Amber Agriculture in 2003.

His personal injury practice includes advice on professional negligence and defamation.

His practice also includes commercial and contract litigation.
Peter is also a Writer to the Signet and was an Associate Partner in Brodies, W.S., Edinburgh, as well as being a qualified solicitor in England before calling at the Bar. His experience as a solicitor included acting for major landed estates in Scotland and representing major breweries and cinema chains in liquor licensing.
He is a member of the Faculty of Advocates' Personal Injury Law Group and the Faculty of Advocates' Criminal Bar Association.

Cases, trials, inquiries

1. Arbitration between  Southesk Farms and Amber Agriculture Ltd.  Award by Arbiter appointed by the Scottish Ministers dated 7th January 2003 (National Archives of Scotland Ref: SE/RAD/4/3/6). A major agricultural holdings rent arbitration.
2. MacDonald –v- West Minch Salmon Ltd and South Uist Estates Ltd  2004 S.C. 733 concerning the extent of  the right of the landlord of a croft to grant access over the croft land to third parties.
3. Graham –v- Brownson & Ors LTS/LO/2002/28 a Lands Tribunal case concerning title restrictions impeding a proposed development.
4. MacColl –v- MacGillivray 2004 SLCR 112. A Land Court case concerning whether proper consent had been given by the Crofters Commission to a croft letting and the jurisdiction of the Scottish Land Court to reduce a decision of the Crofters Commission.

On 10th May 2007 Peter delivered a lecture at the Crofting Law Conference in Inverness presented by the W.S Society in association with the Crofting Law Group and chaired by the Hon.
