Arnot Manderson Counsel appear before new UK Supreme Court
14th December 2009
Three members of Arnot Manderson Advocates were instructed to appear in the first Scottish case to be heard before the new United Kingdom Supreme Court. Gordon Jackson QC and Claire Mitchell appeared on behalf of the appellant in the case of Allison v HMA, while Gordon Balfour appeared on behalf of the Crown.
Gordon Balfour also appeared on behalf of the Crown in the related case of McInnes v HMA. Both cases concerned the consequences of the Crown's failure to disclose information to the defence prior to a trial.
Claire Mitchell also appeared as Junior Counsel in the same sitting of the Supreme Court in the case of Sean Martin. This appeal was the first constitutional challenge to the powers of the Scottish Parliament in promulgating legislation which, it was argued, was outwith the scope of its devolved powers.
